1. Acceptance of Terms

By accessing or using the AmaWaterways River Borne Foundation website (“River Borne Foundation,” “we,” “us,” or “our”), submitting a donation, or otherwise interacting with us online, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our website.

We reserve the right to update these Terms at any time. Changes will be effective upon posting to our website, with the “Last Updated” date revised accordingly. Your continued use of the website following any update constitutes acceptance of the revised Terms.


2. About River Borne Foundation

AmaWaterways River Borne Foundation is a nonprofit organization incorporated under the laws of the State of Delaware. We have received tax-exempt status under Section 501(c)(3) of the Internal Revenue Code, EIN: 42-2948357. Our mission is to embrace travel as a force for good by empowering communities we serve, places we live, and in destinations we sail.

River Borne Foundation is affiliated with AmaWaterways, LLC. However, River Borne Foundation is a legally separate entity. Donations made through this website are made to River Borne Foundation and not to AmaWaterways, LLC.


3. Donations

General

All donations made through our website are voluntary contributions to support the charitable mission of River Borne Foundation. By submitting a donation, you represent that you are the authorized owner or holder of the payment method used and that the information you provide is accurate and complete.

No Goods or Services in Exchange

Unless explicitly stated at the time of a specific fundraising campaign or event, donors receive no goods or services in exchange for their contribution. Where goods or services are provided, the fair market value of those items will be disclosed, and only the amount exceeding that fair market value may qualify as a charitable deduction. Donors are encouraged to consult a qualified tax advisor regarding deductibility of their gift.

All Donations Are Final

All donations are final and non-refundable except at the sole discretion of River Borne Foundation. If you believe a donation was made in error, please contact us at info@riverborne.org within 30 days of the transaction and we will review your request on a case-by-case basis.

Recurring Donations

If you elect to make a recurring donation, your payment method will be charged automatically at the frequency you select (monthly, quarterly, or annually) until you cancel. To cancel or modify a recurring donation, please contact us at info@riverborne.org or +1 866-526-6078 at least 5 business days before your next scheduled charge. River Borne Foundation is not responsible for charges that process before a cancellation request is received.

Use of Donated Funds

River Borne Foundation will make reasonable efforts to apply donations in accordance with any designation made at the time of giving. However, if a designated program is discontinued, fully funded, or otherwise unable to receive funds, River Borne Foundation reserves the right to redirect contributions to a program of similar charitable purpose at its discretion. Donors will be notified of any such redirection where practicable.

Tax Acknowledgment

River Borne Foundation is a 501(c)(3) tax-exempt organization. Donations may be tax-deductible to the extent permitted by law. A donation receipt will be sent to the email address provided at the time of your gift. River Borne Foundation does not provide individual tax advice; please consult a qualified tax professional regarding the deductibility of your contribution.


4. Intellectual Property

All content on this website — including text, photographs, graphics, logos, project descriptions, and other materials — is the property of AmaWaterways River Borne Foundation or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not, without our prior written permission:

Any dispute arising out of or relating to these Terms or your use of this website shall be resolved exclusively in the state or federal courts located in USA, California, and you consent to the personal jurisdiction of such courts.

Before initiating any legal action, you agree to contact us at info@riverborne.org to attempt to resolve the matter informally. We will make reasonable efforts to address your concern within 30 days of receiving written notice.
